1. Agreement to Terms

By using Clickstream's services or website, you agree to these Terms of Service. These terms apply to clients globally, including those in the United States, European Union, Australia, and New Zealand.

2. What We Provide

Clickstream builds custom revenue and operations systems for AV installation companies, home automation integrators, and commercial AV firms. We integrate with your existing tools (CRMs, email, SMS, scheduling platforms) to automate lead response, quoting, technician coordination, and operational tasks. Specific deliverables are outlined in your service agreement.

3. Your Responsibilities

You agree to:

  • Provide accurate business information and system access needed for implementation
  • Ensure you have rights to share any data or content with us
  • Comply with applicable laws (including GDPR, CCPA, and local data protection regulations)
  • Pay agreed-upon fees on time
  • Not use our services for illegal purposes or to send spam

4. Service Availability

We maintain 99.9% uptime for production workflows. Scheduled maintenance will be communicated in advance. We're not liable for downtime caused by third-party services (CRMs, email providers, etc.) or circumstances beyond our control.

5. Intellectual Property

Clickstream retains ownership of our proprietary methods and tools. Custom workflows built for you remain your property. You retain all rights to your data, customer lists, and business content.

6. Confidentiality

We treat your business data, customer information, and system credentials as strictly confidential. We won't share your information except as required to deliver services or by legal obligation. See our Data & Security page for technical details.

7. Value Guarantee

We stand behind the value of our services. If we fail to deliver measurable value as defined in your service agreement, you may request a refund of fees paid for services not yet delivered. This guarantee applies when:

  • We fail to implement agreed-upon workflows within the specified timeframe
  • Implemented automations do not function as documented
  • We fail to meet defined performance metrics outlined in your service agreement

Refund requests must be submitted in writing with specific documentation of how deliverables were not met. This guarantee does not apply to issues caused by third-party service outages, client-side changes to systems, or factors outside our control.

8. Limitation of Liability

To the extent permitted by law, our total liability is limited to fees paid in the prior 12 months. We're not liable for indirect damages, lost profits, or issues caused by third-party services beyond our control.

9. Termination

Either party can terminate with 30 days' written notice (or as specified in your service agreement). We'll help transfer your data and provide documentation for active workflows. Outstanding fees remain due.

10. Governing Law

These terms are governed by the laws of your jurisdiction. For EU clients, GDPR applies. For California clients, CCPA applies. We comply with applicable consumer protection laws globally.

11. Changes to Terms

We may update these terms with 30 days' notice to active clients. Continued use after changes go live means you accept the updated terms.
